Jack Smith Moves to Dismiss Federal Cases Against President Trump as Trump Signals Plans for Major DOJ Overhaul
On Monday, Special Counsel Jack Smith filed motions to dismiss both federal cases against former President Donald Trump: the January 6 case and the classified documents case. The move comes amid reports that Trump, following his re-election victory, plans to overhaul the Department of Justice (DOJ) and fire Smith’s team of prosecutors.
Background on the Federal Cases
In June 2023, Smith indicted Trump on 37 federal counts related to the alleged improper storage of classified presidential records at his Mar-a-Lago estate, which is protected by the Secret Service. A subsequent superseding indictment in July 2023 added three charges, claiming Trump conspired to delete security footage from the estate.
In September 2023, Smith brought charges against Trump in the January 6 case, including conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of an official proceeding, and conspiracy against rights.
Motion to Dismiss
Smith’s motion to dismiss both cases references constitutional protections for a sitting president, stating that the DOJ cannot pursue federal prosecutions once Trump is inaugurated on January 20, 2025.
“As a result of the election held on November 5, 2024, the defendant, Donald J. Trump, will be inaugurated as President on January 20, 2025,” Smith wrote. “It has long been the position of the Department of Justice that the United States Constitution forbids the federal indictment and subsequent criminal prosecution of a sitting President.”
Smith noted that this policy is binding regardless of the severity of the charges, the strength of the evidence, or the merits of the case.
“The prohibition is categorical and does not turn on the gravity of the crimes charged,” Smith added.
Trump’s Planned DOJ Overhaul
Reports indicate that President Trump intends to dismiss Jack Smith’s entire team of prosecutors upon taking office. According to sources cited by The Washington Post, Trump plans to assemble new investigative teams within the DOJ to scrutinize the 2020 election and alleged voter fraud in key battleground states.
“President-elect Donald Trump plans to fire the entire team that worked with special counsel Jack Smith to pursue two federal prosecutions against the former president, including career attorneys typically protected from political retribution,” The Washington Post reported.
The report also stated that Trump would prioritize an investigation into alleged irregularities in the 2020 election, with plans to use the DOJ to uncover evidence of fraud.
Reaction from Trump’s Team
Trump’s senior advisor, Steven Cheung, released a statement in response to Smith’s motions, applauding the dismissal but reinforcing the campaign’s commitment to holding those involved in prior investigations accountable.
Smith’s team, which reportedly operated with a budget and staffing twice that of Special Counsel Robert Mueller’s investigation, faced criticism from Trump’s allies for being politically motivated and disproportionately targeting the former president.
The developments set the stage for significant changes within the DOJ as President Trump prepares to implement his vision for accountability and justice reform.
